This Acceptable Use Policy (the "AUP") governs your use of the cobalt12 service operated by CobaltAI OÜ (registry code 17561613). It is incorporated into and forms part of our Terms of Service. Capitalised terms have the meaning given in the Terms.
Violation of this AUP may result in immediate suspension or termination of your account without refund, and in reporting to a marketplace, rights holder, or competent authority where we are required or reasonably believe it necessary.
You must not use the Service to create, prepare, or publish content that:
1.1 uses a brand name, trademark, logo, trade dress, or other proprietary identifier that you do not own and are not authorised to use;
1.2 describes goods as "genuine", "original", "authentic", "OEM", or equivalent in relation to a brand you are not authorised to represent;
1.3 uses another party's part numbers, model designations, or catalogue identifiers in a way that suggests affiliation, endorsement, or origin;
1.4 reproduces third-party photographs, artwork, packaging, text, or other copyrighted material without a licence;
1.5 promotes counterfeit, replica, imitation, unauthorised, grey-market, stolen, or unlawfully sourced goods;
1.6 infringes any patent, design right, database right, trade secret, or other intellectual property right.
Note on compatibility statements. Factual compatibility claims ("compatible with", "fits") may be permitted in some jurisdictions and under some marketplace policies, and prohibited in others. You are responsible for confirming what is permitted for your products and markets. The Service does not make this determination for you.
You must not use the Service to create, prepare, or publish content that:
2.1 misrepresents a product's identity, origin, manufacturer, materials, dimensions, weight, capacity, contents, condition, or specifications;
2.2 states or implies certifications, test results, standards compliance, or approvals that the product does not hold;
2.3 makes health, medical, therapeutic, nutritional, safety, or disease-related claims that are false, unsubstantiated, or prohibited for the product category or jurisdiction;
2.4 makes environmental or sustainability claims that are unsubstantiated or misleading;
2.5 contains fabricated reviews, ratings, testimonials, endorsements, user counts, popularity indicators, or other false social proof;
2.6 makes performance, savings, or earnings claims that are not substantiated.
You are responsible for verifying every factual statement in Output before publishing it. Output is machine-generated and may contain fabricated specifications, claims, or identifiers.
You must not use the Service in connection with:
3.1 weapons, ammunition, explosives, or their components; items designed to cause harm;
3.2 illegal drugs, controlled substances, precursors, or drug paraphernalia;
3.3 products subject to recall, or products banned or restricted in the market where they will be listed;
3.4 goods that infringe sanctions or export control restrictions;
3.5 sexually explicit material, or products marketed in a sexualised manner;
3.6 products marketed to, or depicting, minors in any inappropriate manner;
3.7 human remains, endangered species products, or other goods whose trade is unlawful;
3.8 any product category prohibited by the marketplace on which it will be listed.
Regulated categories — including supplements, cosmetics, medical devices, children's products, food, chemicals, and electronics subject to safety standards — require additional care. The Service does not verify regulatory compliance for these categories.
4.1 You must not use the Service to generate imagery that misrepresents what a buyer will receive, including depicting a product that differs from the actual item in colour, form, contents, quantity, or included accessories.
4.2 You must not generate imagery depicting an identifiable real person without that person's consent, or content designed to imitate a specific individual's likeness or voice.
4.3 Where imagery generated with the Service contains synthetic or AI-generated depictions of people, you are responsible for applying any disclosure, label, or metadata tag required by applicable law or marketplace policy in your target markets. Where the Service offers such tagging, it is an aid and does not transfer responsibility to us.
4.4 You must not remove, obscure, or alter provenance metadata, watermarks, or disclosure tags applied by the Service.
You must not:
5.1 reverse engineer, decompile, disassemble, or attempt to derive the source code, models, prompts, or underlying technology of the Service;
5.2 use the Service to develop a competing product, or to benchmark it for a competitor, without our prior written consent;
5.3 access the Service by automated means except through interfaces we provide, or circumvent rate limits, quotas, credit allowances, watermarks, or access controls;
5.4 resell, sublicense, or provide the Service to third parties except as expressly permitted by your plan;
5.5 share account credentials, or create multiple accounts to obtain additional free allowances;
5.6 upload malware, or interfere with, overload, or disrupt the Service or its infrastructure;
5.7 attempt to access data belonging to another customer, or probe or scan the Service for vulnerabilities other than through a responsible disclosure to [email protected];
5.8 use the Service in any way that would place us in breach of a marketplace's terms, API licence, acceptable use policy, or data protection policy.
6.1 You must not upload personal data that you have no lawful basis to process, and must not upload special category data (health, biometric, racial or ethnic origin, political opinions, religious beliefs, trade union membership, sex life or sexual orientation).
6.2 You must not upload photographs of identifiable individuals without the necessary consents or model releases.
6.3 You must not use the Service to scrape, harvest, or compile personal data about individuals.
7.1 We may investigate suspected violations and may remove content, suspend features, suspend the account, or terminate access. Where practicable and lawful, we will give notice and an opportunity to cure; for serious violations we may act immediately.
7.2 We may preserve and disclose content and account information where required by law or where we reasonably believe disclosure is necessary to protect our rights, the safety of any person, or the integrity of the Service.
7.3 Termination for AUP violation does not entitle you to a refund and does not limit our other remedies, including under the indemnity in the Terms.
